A BRIEF DISCUSSION OF A FATWA PROHIBITING POKEMON

The following discussion of old and new fatwas about Pokemon illustrates how even an innocent or innocuous children’s cartoon is made into a symbol of a binary division worldwide by islamist extremism.

Sheikh Yusuf al-Qaradawi issued a fatwa prohibiting the Japanese Pokemon cartoon series and related films and games, “in order to protect the minds, beliefs and character of our children as well as their money: these people have perfected the art of looting it from them by consent, and gradually drawing their fathers and mothers into agreement also.”

Sheikh Qaradawi explained that his fatwa prohibiting Pokemon was issued after discussion broke out about Pokemon, its Sharia ruling and whether it is halal or haram. The Sheikh added, “I was asked about this by many fathers and mothers concerned about bringing their children up in an authentic Islamic way, in which their beliefs would be sound, their worship correct, their souls purified and their manners and character upright.”

Qaradawi emphasised that his fatwa was based upon the views of devout believers who were also experienced thinkers and who knew the issues of art, drama and TV series etc. He warned that Muslim jurists must not rush to pronounce judgment on such issues before knowing its reality, “for the judgment upon something is derived from its conception, and the jurists usually are not aware of such matters because they do not watch such series or games, especially since these are for children.”

Sheikh Qaradawi specified five reasons that led him to prohibit Pokemon:

  1. It is a danger to our creed (‘aqidah), since it is based on Darwinian thought, known as the theory of evolution, the development of species and types from lower to higher and more powerful creations.
  2. It is a danger to a child’s mentality and his good, intellectual upbringing, since it implants in his mind imaginary matters that have no foundation, supernatural things that are not consistent with God’s natural ways. This is because these insects or new creatures (Pokemons) have weird and wonderful qualities that have no basis in either reason or tradition.
  3. Pokemon is a danger to a child’s character and their good relationship with those around them, since the film has unearthed the theory of conflict and survival of the strongest, which is also a Darwinian theory. The film and TV series promote perpetual conflict, continuous fighting and a cycle of violence amongst its characters.
  4. The Pokemon game involves a type of gambling [in this case, spending money without equal counter-value], which is prohibited by the Sharia, since the upgrades are sold for tens, hundreds or even thousands of riyals, dirhams, pounds or dinars, especially the most powerful upgrades.
  5. Pokemon has characteristic symbols that have their own indications, e.g. the “six-pointed star” that is related to Zionism and Freemasonry, and which has become a symbol of the usurpatory state named “Israel.”

[6] Qaradawi called upon Muslims and Arabs to have “our own special products that express our beliefs, values, laws, customs, heritage and civilisation. Our innovative writers, academics, artists, technologists, the rich and the powerful should work together to do this. Thus, we should present films and cartoon series that carry our message and express our personality and religious, cultural and civilisational identity in simple, eloquent and attractive language.”

Brief comments on the above points by Usama Hasan:

  1. Darwinism: interestingly, a leading 19th-century Western scientist regarded this as a Muslim theory: “ … the Mohammedan theory of the evolution of man from lower forms, or his gradual development to his present condition in the long lapse of time.” (History of the Conflict between Religion and Science by John William Draper, 1811-1882, Electronic Text Center, University of Virginia Library, p. 188) Furthermore, Sheikh Qaradawi himself later moved away from this blanket condemnation of evolutionary theory: “Even research into the beginning of creation [is allowed in Islam], as long as one keeps in mind that we are looking into creation, meaning that there is a Creator … Even if we assume that species evolved from species, this is only by the will of the Creator, according to the laws of the Creator … If Darwin’s theory is proven, we can find Qur’anic verses that will fit with it …” Al-Jazeera TV (Al-Shari`ah wal Hayat, Arabic), 3 March 2009
  2. This discussion could be applied to many weak hadiths and also to fiction, including science fiction that is known to help inspire scientists, e.g. Arthur C Clarke’s famous predictions of the emergence of the internet and other developments.   3. For sure, violence in films, TV shows and computer games is a major matter of concern for humanity worldwide. However, Sheikh Qaradawi’s concern in this regard is undermined by his other fatwas permitting the murder of Israeli civilians, since he regards Israel as a “militarised society” and therefore does not recognise any Israeli adults as civilians.

    Note also that the “survival of the fittest” is an aspect of our biological nature that was recognised by Muslim thinkers over a thousand years ago, including Al-Jahiz (776-869 CE) and his “Struggle for Existence” theory that anticipated a type of crude Lamarckism, one of the precursory theories to Darwinian evolution. (See Rebecca Stott, Darwin’s Ghosts, Bloomsbury, 2012, Chapter 3: Al-Jahiz; cf. also Jim al-Khalili, Pathfinders, p. 76)

  4. Certainly, wasting large sums of money on useless computer games is wrong. But relaxation is part of, and preparation for, worship of God in the Islamic tradition and people are entitled to have a small budget for such leisure. Furthermore, computer games can aid and develop some neural and reflex skills.
  5. Note that the Moroccan flag, pre-Israel, also carried a six-pointed star, also known as the Star of David (Arabic: najm Dawud) or the Seal of Solomon (khatam Sulayman). Six-pointed stars are also found engraved on the walls built by the Ottoman Muslim ruler Sultan Suleyman the Magnificent around Al-Aqsa Mosque in Jerusalem, and on the tomb of the Prophet Muhammad’s maternal aunt Umm Haram in Cyprus (http://keehuachee.blogspot.co.uk/2013/07/part-2-hala-sultan-tekke-mosque-in.html). Since David and Solomon are revered “Prophet-Kings” in the Qur’an and the Islamic tradition, it is wrong to condemn their symbols. Indeed, Sufis such as Idries Shah and Martin Lings comment on the vertical-horizontal mystical symbolism of the six-pointed star.

    Furthermore, researchers into anti-semitism correctly note that “criticising Israel is not anti-semitism, but singling Israel out amongst the world’s states for criticism is anti-semitism.” (Similarly, I would argue that criticising Islam is not Islamophobia, but singling out Islam amongst the world’s religions, philosophies and traditions for criticism is Islamophobia.)

  6. The desire to preserve one’s own values is understandable, but nationalism taken to an extreme becomes fascism. The above fatwa was issued before 9/11 and smacks of divisive, us-vs.-them discourse, not to mention that it places Japanese Muslims in a very difficult situation, cf. A History of Islam in Japanhttps://unity1.files.wordpress.com/2009/06/islam-in-japan.pdf). It is also unhelpful for Western Muslims, Chinese Muslims, Indian Muslims and others. There is a certain irony about an Arab Sheikh using Western and Japanese technology to promote a xenophobic message, as though violence and other problematic issues do not exist within Arab and Muslim culture.

    The 99 (Islamic Superheroes) by Dr Naif al-Mutawa, produced 2006-2013, are arguably the kind of thing that Qaradawi was calling for. But here is a sobering reminder of some of the reaction to it (https://en.wikipedia.org/wiki/The_99): Saudi clerics ruled the series blasphemous because the superheroes of its title are based on the 99 attributes ascribed to Allah in the Holy Quran. The Grand Mufti Abdulaziz al-Sheikh said, “The 99 is a work of the devil that should be condemned and forbidden in respect to Allah’s names and attributes.” The original comic strip version, first released in 2006, had already run into opposition from Muslims not only in Saudi Arabia but also in neighboring Kuwait, where it was created and produced by media executive Nayef al-Mutawa. Andrea Peyser, columnist at the New York Post, wrote in October 2010: “Hide your face and grab the kids. Coming soon to a TV in your child’s bedroom is a posse of righteous, Sharia-compliant Muslim superheroes, including one who fights crime hidden head-to-toe by a burqa.” In 2014, The Kuwait Times reported that ISIL members had issued death threats and offered unspecified rewards for the assassination of Dr. Al-Mutawa, via Twitter. Al-Mutawa defended the work saying that he had received clearance from sharia scholars and never would have gone ahead with the project had he not.

What we do need now is an inclusive discourse of universal, shared values, of replacing a “clash of civilisations” with a dialogue and co-operation of civilisations.

Hadiths on Female Circumcision (FGM)

Bismillah. Further to Quilliam’s press release last week against the call to reintroduce female circumcision (FGM) in the Maldives, here are further thoughts on the issue, including a discussion of hadiths about the subject:

1. FGM is a cultural practice that was known in pre-Islamic Arabia. It is also found in parts of Africa.

2. FGM has no religious Islamic sanction – there are just two traditions on the subject, both of which are strongly disputed, with many jurists throughout history discounting them as having nothing to do with the Prophet of Islam.

There are two hadiths in the Sunan collections (medium-level authenticity) relevant here. To paraphrase, these two hadiths say, “Cut, but don’t cut too much” and “Female circumcision is a way of honouring (!) women.”

The isnads (chains of narration) of these two hadiths are acknowledged to be weak, including by the Sheikh Albani. However, regrettably, Albani judged that the two hadiths support each other and that they are therefore sound (hasan). This judgment is quoted by many writers, including the influential Saudi scholar al-‘Arifi/’Urayfi in his “Etiquettes of Welcoming the Newborn in Islam” (Adab Istiqbal al-Mawlud fil Islam), to support FGM. [Note that thousands of copies of the latter book in Arabic were distributed for free in the UK by salafist organisations.]

However, the UK-based British-Iraqi Sheikh Abdullah al-Judai vehemently disagrees with Albani about this, declaring these hadiths to be seriously weak and FGM to be a custom not approved by Islam. [See Postscript below for more details.]

Here, it is worth analysing three claims made in the recent Lapido Media article on Maldives FGM (http://www.lapidomedia.com/node/3987):

(a) “the four Sunni schools approved of female circumcision”

This may well be the case, because of the above hadiths being accepted by jurists without scrutiny, although many Hadith scholars pointed out their weakness. Like the blasphemy and apostasy laws of medieval Islam, FGM became a theoretical juristic position even though it was rarely practiced. These issues need to be addressed by the proponents of so-called “traditional Islam” (that is actually mediaeval Islam), of both the madhhabist and salafist varieties.

(b) “one reason for this was to reduce women’s sexual appetite”

Ibn Taymiyyah certainly says so, and endorses it. He goes on to claim that “non-Muslim women, being uncircumcised, have excessive sexual desire.” (Ibn Taymiyyah, Fatawa al-Nisa’ or Jurisprudential Pronouncements relating to Women.) Other mediaeval jurists, also known for their xenophobia and misogyny notwithstanding positive qualities in other aspects, probably agreed with him.

(c) [A Maldivian cleric] quotes a hadith of the collection by Prophet Mohammed’s wife, Aisha, as saying, ‘A bath becomes obligatory if one sleeps with your wife and the circumcised parts touch each other.’ The cleric concludes: ‘The word circumcision has been applied to both men and women here. The hadith demonstrates that women must be circumcised as well.’

This hadith may be more sound but, as Sheikh Judai states, it contains no approval of (male or female) circumcision, merely providing a factual description. To claim that this hadith obliges FGM (“women must be circumcised”) is an example of very poor and flawed logic and juristic reasoning.

3. The fact that FGM is cultural, not religious, is obvious from two matters: (i) it is/was known in non-Muslim communities in Arabia and parts of Africa; (ii) female circumcision is a very rare practice in the Muslim world, unlike male circumcision that is universal in Muslim societies.

4. The hadith (of 40 Nawawi) and fundamental Sharia principle of outlawing harm (la darar wa la dirar), that is based on numerous Qur’anic verses, dictates a total Islamic ban on FGM today, now that the medical, physiological, sexual, emotional and psychological harms are indisputable. This is the position of Al-Azhar and other institutions.

5. We should welcome the recent tougher legislation and enforcement against FGM in the UK and commend the campaign of the young British-Somali woman from Bristol in this regard. We should note also that there a number of British clerics who are stuck in a mediaeval mindset and poor understanding of the hadiths and fiqh (jurisprudence) who openly promote FGM and regard it as “preferable” because of what is written in centuries-old human texts. I hope that these clerics will reconsider their positions, both intellectually and societally.

6. The literalist, fundamentalist thinking behind this call in the Maldives has also given rise to the same cleric’s insistence on the reintroduction of ancient hudud punishments such as amputation and flogging, that have no place in modern society. These punishments were abolished by the scholars and sultans of the Ottoman Empire in the 1850’s, but have been reintroduced in Muslim-majority countries by literalists in the 20th and 21st centuries.

7. An example of the danger of the above is the case of the 15-year old Maldivian girl who was sentenced to flogging for fornication, even though she was the victim of rape and sexual abuse by her stepfather. This sentence under the regressive hudud laws was only overturned after a year-long international uproar and campaign (eg https://www.amnesty.org/en/news/maldives-girl-rape-victim-be-spared-outrageous-flogging-sentence-2013-08-21), in which I served as Avaaz’s consultant on Islamic law in 2013. And, of course, there have been many similar contemporary cases under hudud laws in Pakistan, Nigeria, Saudi Arabia, Iran, Afghanistan and other countries.

Postscript: In 2004 I attended some sessions near Watford (UK) of the European Council for Fatwa and Research, as an observer. The scholars present included Sheikhs Ibn Bayyah, Qaradawi, Judai, Faysal Mawlawi, Qarahdaghi, Anas Abu Ghuddah, Suhaib Hasan and others.

The FGM issue came up. A French-Arab cleric had written in his submission that FGM was recommended, based on the hadiths discussed above (no. 2). Sheikh Judai disagreed vehemently, stating that FGM is not a sunnah and declaring that “These hadiths are utterly weak, even though Sheikh Albani, whom I venerate in Hadith studies, authenticated them!” No other scholar contradicted Judai in that session. I asked him afterwards about the “circumcised parts meeting” hadith: he immediately replied that it contains no promotion of FGM, being merely a description (cf. 2c above).

As Imam Ghazzali said, as quoted by Ibn Bayyah, nine-tenths (90%) of juristic understanding is to understand society and other contextual realities. Even total mastery of the scriptural texts (Qur’an and Hadith) comprises no more than one tenth (10%) of jurisprudence.

Muslim clerics and jurists need to develop deeper understanding of scripture as well as human nature and society before pronouncing on critical issues and promoting harmful rules and laws for entire populations in the name of God.

Death Threats to Sayyid al-Qimni, Egyptian historian and thinker

People have pointed out that Sheikh Ali Gomaa (who is Shaykh al-Azhar, not the Grand Mufti) is against the death penalty for apostates, so he can’t have encouraged killing Qimni.  It seems he may have been asked about Qimni and said that he was an apostate.  This might be insensitive, given what happened to Faraj Fouda & Nagib Mahfuz.

Similarly, it is unlikely that the Muslim Brotherhood would officially call for Qimni’s killing.  It has millions of supporters though, so some of them might have done.  It should also be pointed out that the MB has repeatedly suffered the arrest without charge of some of its members over the years, and this continued recently.  Egyptian society needs greater openness and justice.

The whole situation is actually a good opportunity for Al-Azhar, MB, Sh. Qaradawi and others to calm people down and show some maturity and wisdom, dialogue and engagement rather than rushing to death threats at the slightest whiff of heresy.  Surely the last thing Egypt and Islam need is another Faraj Fouda or Salman Rushdie situation?

With the Name of Allah

The secular, liberal Egyptian historian and thinker Sayyid al-Qimni, son of a traditionalist Azhari sheikh, has had serious death threats issued against him by many (mainly extremist) religious scholars in Egypt since the end of June, as detailed in his Appeal (below) which he describes as ” a distress call to all bodies and individuals, a call to the consciences of every free individual in the world.”

The latest threats to him seem to have been sparked by his being elected to receive the Egyptian State Award for Social Sciences on June 25th.

In particular, it is alleged that those who have declared that he is an apostate and should be killed (perhaps even by ordinary Egyptians, not just by the state) include:

1- The Muslim Brotherhood
2- Al-Azhar Scholars’ Front headed by Yahya Ismail Habloush
3- 5,000 mosque khatibs in their Friday sermons on July 24th
4- Sheikh Ali Gomaa himself (currently still the Shaykh Al-Azhar, as far as I know)

The situation of a polarisation between religious and secular currents in is repeated in different Muslim-majority countries, eg Pakistan, Turkey, North Africa, etc., so this case is symbolic of a much wider and deeper issue, of course.

Whatever we feel about his views (I think he’s too apologetic about the history of Jihad, for example, and he should not ridicule the Islamic practice of constant remembrance of God out of frustration with the religion-exploiters), clearly, the death threats are pathetic, appalling and totally unacceptable.

Now, our FCO and embassy in Cairo has been working with Sheikh Ali Gomaa and Al-Azhar over the last few years, and also recently hosted the charming Rector of Al-Azhar in the UK.  The Archbishop of Canterbury has also been working with Sheikh Gomaa – I was present last year at Cambridge University when they were the two main speakers at a “Common Word” event.  I also took part in the FCO Projecting British Islam delegation to Egypt last year, which is partly why the matter concerns me.

I’m therefore asking for your help in encouraging our friends in the following places to do the right thing in this regard (and praying to God that they do so, if appropriate!): i.e. to investigate the death-threats and to take appropriate steps to promote peaceful dialogue and debate, including between secularists and fundamentalists, believers and non-believers, etc.

1- The FCO, especially the Foreign Secretary
2- Our embassy in Cairo, as well as the embassies there of other influential countries
3- Al-Azhar University and its various affiliated institutions
4- The office of Sheikh Ali Gomaa
5- The Muslim Brotherhood
6- The office of Sheikh Yusuf al-Qaradawi.  Qimni is highly-critical of Qaradawi.  From what I know of Qaradawi, he is at least open and committed to dialogue with others, plus he has a less-hardline position on the alleged death-penalty for apostasy.  Therefore, perhaps he may be able to have a calming influence here.
7- Religious scholars and shaykhs generally, especially those with links to the UK & Egyptian governments and religious circles
8- Lambeth Palace & the office of Dr. Rowan Williams
9- Members of the “Common Word” initiative
10- Human rights organisations & lawyers

I would appreciate your advice, suggestions, help, prayers, etc.  Please publicise this matter and forward it to the relevant people.  I attach pertinent quotes and some weblinks below.

AN APPEAL TO THE WORLD’S CONSCIENCE
From the Egyptian writer and academic researcher of Islamic Affairs, Dr. Sayed Mahmoud El Qemany, who is being exposed to incitements to assassinate him

In the context of my academic research and practical work I have been able to provide an important set of motion in the stagnant Egyptian situation. I have attempted to make reforms from the inside and worked on the disarmament of those who exploit Islam politically and make it a source of livelihood at the expense of the simple, good people of Egypt. I have therefore created a secular movement that has imposed its presence, although still at a formative stage.

In a free ballot of Egyptian thinkers, I was granted the State Award for Social Sciences, on June 25th 2009. The hard-line radical militant groups considered that the state has adopted this intellectual secular trend officially, infuriating the mentioned group which called on the State to withdraw the prize with the declaration of my defection from Islam and excommunication which means in our country, I could be slain; any citizen is allowed to kill me and be awarded by God in Paradise.

The following parties have participated in the statements of excommunication (takfir), noting that none of them have read a single word of what I wrote, and have not been able to hold a dialogue to discuss my ideas:

1 – Al-Azhar Scholars Front headed by Yahya Ismail Habloush, which issued the first statement of excommunication on July 10, 2009.
2 – The Islamic Group (condemned terrorist group) issued a statement of excommunication on July 10, 2009.
3 – The Muslim Brotherhood hailed the excommunication, and were represented at the parliament by Hamdi Hassan requesting the withdrawal of the award and the declaration of religious-defection and excommunication on July 7, 2009. The Muslim Brotherhood also declared my excommunication on Mohwar Channel on July 11, 2009 and on Al Faraeen Channel on July 13, 2009.
4 – The Salafi (Fundamentalist) Group (condemned terrorist group) dedicated its Internet site named “The Egyptians” for excommunicating me and incitements to kill me, since the date of obtaining the prize until today.
5 – Al Nas channel, which represents the theoretical side of bloody terrorism which declared excommunication and demanded “all citizens who can” to kill me immediately, on July 24 and 25, 2009.
6 – The Hisbah Sheikh Youssef Al Badri in Egypt declared on the channel “ON TV” on July 3, 2009 that I have cursed God and the Prophet Mohammad in my books even though I have challenged him and others to refer to a single text written by me where such claims were made. Due to this proclamation, he has issued an incitement to kill me.
7 – A member of the Al-Azhar scholars, Sheikh Mohammed El Berry, on Mihwar TV Channel on July 11, 2009 announced my excommunication as he also said that he did not read any of my writings since he does not read “garbage”. He repeated the same words on the channel “ON TV” on July 22, 2009
8 – Sheikh Ali Gomaa, the former Chairman of the “State Religious Affairs Advisory Board”, issued a statement declaring my infidelity and calling for slaying me for “insulting the Prophet of Islam, the God of Islam” on July 24, 2009.
9 – The Sheiks of more than 5,000 mosques on Friday prayers on July 24, 2009 declared the incitement to kill me, especially in my hometown, which led to the rampage against my family and relatives, and that could possibly evolve to some serious consequences in the coming weeks.

Due to the above, I call upon the conscience of all humanity in the free world to come to me and my children’s rescue by providing moral support and the condemnation and denunciation of the radical thinking with quick solutions to save us from the danger that is luring around us.  This is a distress call to all bodies and individuals. A call to the consciences of every free individual in the world.

We, the Liberal Egyptian intellectuals, students, followers, readers and lovers of Dr. Sayed El Qemany call upon the officials to intervene to save our distinguished and respectable intellectual from the threats of radical Islamic movements who continue to incite to murder him, openly and publicly in mosques and on satellite channels, financed by those who exploit religion to serve their political agendas for nothing but their inability to hold a valid and a scientific argument with him and totally lost their minds over his being granted the State Award for Social Sciences, The fact that lead to their predicament that the state has adopted a secular ideology, which is synonymous with heresy and atheism in their ignorant minds.

We also urge the Press Syndicate to address the abuses of the fundamentalist brothers Mahmoud and Gamal Sultan as well as Jamal Abd al-Rahim against Dr. El Qemany inciting the general public to kill him.
